The seriousness of your driving while suspended charge, the type of penalties you face, depends in large part on whether your suspension was related to DUI charges or not, and whether this is your first, second or subsequent offense for driving while your operating privileges suspended or revoked.
Suspension Related to DUI: If you are convicted of driving with a suspended driver’s license and your suspension was related to a DUI charge or chemical test refusal, you could lose your license for a year, be fined $500 and face imprisonment for at least 60 days.
If your blood alcohol content when you arrested for drunk driving was .02 or greater, the possible sentences for driving while suspended are even greater: loss of your license for a year, a mandatory fine of $1,000, and mandatory imprisonment for not less than 90 days.
