When you are pulled over for a DUI and asked to take a field sobriety test, you may not know if you have a right to refuse to take a breath test or how a chemical test refusal or breath test results will affect the outcome of your case. Whether you submitted to or refused a breathalyzer, blood test, or chemical test in Pennsylvania, it is important to work with a lawyer who can explain your rights and will work tirelessly to ensure they are protected.

To speak directly with an attorney about your case, please call me directly at 610-239-8870 or contact me by email. I offer experienced, strategic and aggressive advocacy focused on your rights after challenging the breathalyzer or Chemical test.

Refusing a breathalyzer, or chemical test in Pennsylvania does not mean you will be automatically convicted of drunk driving. There is no criminal penalty for a breath test refusal, and the prosecution still has to prove its case against you. Refusing a chemical test will, however, prompt the Pennsylvania Department of Transportation (PennDOT) to seek a mandatory, one-year suspension of your driver’s license, but this is an administrative matter that can be successfully challenged.

I will handle both the criminal and civil elements of your case. I have extensive experience both in DUI criminal defense and driver’s license suspension administrative hearings.

Defeat Your DUI Charges

As your attorney, I will take immediate action in your case to begin building your defense. I will contact witnesses, review police reports and assess the facts of your case to effectively challenge a chemical test and find holes in the prosecution’s case against you. Even if you did take the test, the evidence may not be admissible if it is found that the device was calibrated improperly or the test was improperly administered. Chemical test refusal is not an admission or a valid defense. You still need an experienced attorney to protect your rights.
