There is no criminal penalty for a breath test refusal, and the prosecution still has to prove its case against you. Refusing a breath test will, however, prompt the Pennsylvania Department of Transportation (PennDOT) to seek a mandatory, one-year suspension of your driver's license, but this is an administrative matter that can be successfully challenged.
